One of the most important types of auto insurance is the insurance you buy for yourself: uninsured motorist and underinsured motorist coverage. If you are injured by a driver who is uninsured or does not have enough insurance to pay for your damages, you could turn to your UM/SUM coverage for the money you need to pay your bills.
At the law firm of Paris & Chaikin, PLLC, in New York City, our attorneys offer a free initial consultation to help you explore all of your options for insurance coverage after an auto accident, including UM/SUM coverage.
Do I Have Uninsured Motorist Coverage?
In New York, insurance companies are required to provide you with coverage for uninsured motorists. The minimum amount of uninsured motorist coverage is $25,000 for one person and $50,000 for two or more people injured in an accident. In addition, you can buy supplemental uninsured motorist (SUM) coverage equal to the amount of liability insurance you carry, up to $250,000 per person and $500,000 for two or more people injured in an accident.
SUM insurance is a bargain considering the extra level of protection it provides you and your family. According to the Insurance Research Council, 9 to 11 percent of drivers in New York are uninsured. A far greater percentage of drivers are underinsured, carrying only the minimum about of liability coverage, which is $25,000 for one person and $50,000 for two or more people injured in an accident. If you have suffered a serious injury, $25,000 will not go far in paying for your losses.
It's important to seek legal advice when filing an uninsured or underinsured motorist claim. Our lawyer can help you maximize your recovery and avoid mistakes that can result in your insurance company denying your claim. We can also help you file an uninsured or SUM claim if you are an injured pedestrian or bicyclist.
